END USER LICENSE AGREEMENT (EULA)

IMPORTANT: This End User License Agreement (“Agreement”) is a legal agreement between you (“you” or “Customer”) and Hurd Hobbies LLC (“Hurd Hobbies,” “we,” “us,” or “our”). This Agreement governs your purchase and use of (a) our physical goods, including 3D printed resin scaled model parts, complete model kits, and related supplies (the “Physical Product”), and (b) our downloadable digital files such as STL files and related digital assets (the “Digital Product”). Physical Product and Digital Product are collectively the “Product”.

By purchasing, downloading, opening the packaging, installing, printing, assembling, modifying, or using any Product, you agree to be bound by this Agreement. If you do not agree, do not purchase, download, or use the Product.

1. Intended Use; Compatibility
   The Product is intended for private, non-commercial hobby use in constructing scale model kits. Unless explicitly stated by Hurd Hobbies in writing, we do not represent that parts will form, fit, or function when applied to kits not developed by Hurd Hobbies LLC. You are solely responsible for determining suitability for your intended application, including any modifications, adhesives, paints, tools, and assembly methods used.
2. License Grant; No Transfer of Intellectual Property
   Subject to your compliance with this Agreement, Hurd Hobbies grants you a limited, non-exclusive, non-transferable license to use the Product for personal hobby purposes. The Product and all associated designs, sculpts, files (if any), and other intellectual property are owned by Hurd Hobbies or its licensors. No ownership rights are transferred to you.
3. Restrictions
   You may not (a) copy, scan, reverse engineer, or create derivative products from the Product for commercial purposes; (b) reproduce, sell, resell, sublicense, distribute, or otherwise exploit the Product or any design embodied in the Product except as permitted by applicable law; (c) use the Product in connection with unlawful activity. Any unauthorized use terminates this Agreement automatically.
4. Digital Product License; Downloads; No Refunds
   4.1 License; Licensed, Not Sold. Upon purchase, Hurd Hobbies grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Digital Product solely for private, personal hobby use. The Digital Product is licensed, not sold.
   
   4.2 Prohibited Uses (Digital). Unless you have prior written permission from Hurd Hobbies, you may not: (a) sell, resell, sublicense, share, distribute, or transfer the Digital Product; (b) upload the Digital Product to any sharing platform, marketplace, or repository; (c) sell, resell, or distribute any physical items produced from the Digital Product (including printed parts). All rights not expressly granted are reserved.
   
   4.3 Download Limits and Availability. Unless stated otherwise at the time of purchase, the Digital Product may be downloaded up to three (3) times and is available for thirty (30) days from the date of purchase. After that period, access may expire and a new purchase may be required.
   
   4.4 Digital No-Refund Policy. ALL DIGITAL SALES ARE FINAL. Because the Digital Product is delivered electronically, no refunds, exchanges, or returns will be provided once the Digital Product has been delivered or downloaded, to the maximum extent permitted by law.
5. Physical Product Shipping Damage; Missing or Defective Parts
   If Physical Product parts are missing, defective, or broken during shipping, Hurd Hobbies will replace the defective, missing, or broken parts upon your email request to hurdhobbies@gmail.com. You must contact Hurd Hobbies within 15 days of delivery and include your order information and clear photos of the issue when applicable.
6. Returns; Refund Policy (Physical and Digital)
   6.1 Physical Product. Except as expressly stated in Section 5, all Physical Product sales are final. There are no returns and no refunds. Any request raised more than 30 days after delivery will not be eligible for replacement, return, or refund.
   
   6.2 Digital Product. Digital Product sales are governed by Section 4.4 (Digital No-Refund Policy).
7. Assumption of Risk; Safety
   Modeling products may involve sharp tools, adhesives, chemicals, sanding dust, and small parts. You assume all risks associated with handling, assembly, modification, printing, and use of the Product, including any injury, allergic reaction, property damage, or improper results. Use appropriate personal protective equipment and follow all applicable safety instructions for tools, printers, resins, and materials you use.
8. Disclaimer of Warranties
   To the maximum extent permitted by law, the Product is provided “AS IS” and “AS AVAILABLE”. Hurd Hobbies disclaims all warranties and conditions, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow the exclusion of certain implied warranties, so some of these exclusions may not apply to you.
9. Limitation of Liability
   To the maximum extent permitted by law, Hurd Hobbies LLC shall not be liable for any direct, indirect, incidental, special, exemplary, or consequential damages arising out of or related to the Product or this Agreement, including damages for personal injury, lost profits, loss of data, business interruption, failed prints, printer damage, or any other commercial damages or losses, even if advised of the possibility of such damages. In any event, Hurd Hobbies’ total liability for any claim shall not exceed the amount you paid for the specific Product giving rise to the claim.
10. Indemnification
    You agree to defend, indemnify, and hold harmless Hurd Hobbies LLC and its owners, affiliates, and representatives from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your misuse of the Product, your violation of this Agreement, or your violation of any law or the rights of any third party.
11. Governing Law; Venue
    This Agreement is governed by the laws of the State/Commonwealth of North Carolina, without regard to conflict of law principles. Any legal action or proceeding arising under this Agreement will be brought exclusively in the state or federal courts located in Forsyth County/North Carolina, and you consent to personal jurisdiction and venue there.
12. Severability
    If any provision of this Agreement is held to be unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
13. Entire Agreement; Changes
    This Agreement constitutes the entire agreement between you and Hurd Hobbies regarding the Product and supersedes any prior or contemporaneous understandings. Any additional or different terms proposed by you (including on a purchase order) are rejected unless agreed to in a writing signed by Hurd Hobbies.
